Reading Agreement & Terms of Service — From Yonder Shore

1. NATURE OF SERVICE & DISCLAIMER
By booking and/or participating in an astrology reading or consultation ("Reading") with Chris Kaplan/ From Yonder Shore ("Practitioner"), you ("Client") acknowledge and agree to the following:
Astrology and oracle readings are provided for entertainment, personal reflection, and spiritual guidance purposes only. They do not constitute — and are not a substitute for — professional advice in the fields of medicine, psychology, psychiatry, law, finance, or any other licensed profession. The Practitioner makes no guarantees, warranties, or promises regarding outcomes, accuracy, or the fulfillment of any information shared during the Reading.
The Client retains full personal responsibility for all decisions made as a result of, or in connection with, the Reading. The Practitioner shall not be held liable for any actions taken or not taken based on the content of the Reading.

2. PERSONAL INFORMATION & CONSENT
To provide the Reading, the Practitioner may collect personal information including, but not limited to, your name, date of birth, time of birth, and place of birth. By proceeding with the booking, you consent to the use of this information solely for the purpose of conducting your Reading. This information will not be sold, shared, or distributed to third parties without your explicit consent.

3. RECORDING POLICY
Readings may be recorded (audio and/or video) for the Client's personal reference. The following terms govern all recordings:
3a. Practitioner's Right to Record The Practitioner reserves the right to record any Reading session. By booking a session, the Client consents to being recorded unless the Client provides written notice of objection prior to the session.
3b. Client's Right to Record The Client may record their own session for personal use only, subject to the restrictions set forth in Section 4 below.

4. RESTRICTIONS ON USE OF RECORDINGS & CONTENT
All recordings, transcripts, written summaries, and content shared during or arising from a Reading ("Content") are the intellectual property of Chris Kaplan/ From Yonder Shore and are protected under applicable copyright law. The following restrictions apply:
4a. No Unauthorized Sharing The Client may NOT share, distribute, upload, broadcast, or otherwise make available any recording or Content to any third party — whether publicly or privately — without the prior written consent of the Practitioner. This includes but is not limited to sharing via text message, email, or direct message.
4b. No Posting to Social Media or Online Platforms The Client may NOT post, publish, stream, or upload any recording or Content to any social media platform, video-sharing site, podcast platform, website, blog, forum, or any other public or private online space (including but not limited to YouTube, TikTok, Instagram, Facebook, X/Twitter, Spotify, or Substack) without the prior written consent of the Practitioner.
4c. No Editing or Alteration The Client may NOT edit, cut, splice, alter, remix, or modify any recording or Content in any form, nor use any portion of a recording out of context, without the prior written consent of the Practitioner.
4d. No Duplication or Reproduction The Client may NOT duplicate, copy, reproduce, or transcribe any recording or Content for any purpose beyond personal, private reference without the prior written consent of the Practitioner.
4e. No Commercial Use The Client may NOT use any recording or Content for commercial purposes, monetization, or financial gain of any kind without the prior written consent of the Practitioner.

5. PERMISSION REQUEST PROCESS
Clients wishing to share, post, or use Content in any way not permitted under Section 4 must submit a written request to info@fromyondershore.com prior to any such use. The Practitioner reserves the right to grant or deny any permission request at their sole discretion. Approval must be received in writing before any restricted use takes place.

6. VIOLATION OF TERMS
Any unauthorized use, sharing, posting, editing, or duplication of Content constitutes a breach of this Agreement and an infringement of the Practitioner's intellectual property rights. The Practitioner reserves the right to pursue all available legal remedies in the event of a violation, including but not limited to the issuance of takedown notices and claims for damages.

7. REFUND POLICY
All sales are final. No refunds will be issued once a Reading has been delivered. Cancellations made more than 48 hours in advance are eligible for a full refund.

8. LIMITATION OF LIABILITY
To the fullest extent permitted by law, the Practitioner's total liability to the Client for any claim arising out of or related to the Reading shall not exceed the amount paid by the Client for the Reading in question. The Practitioner shall not be liable for any indirect, incidental, special, or consequential damages.

9. GOVERNING LAW
This Agreement shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict of law provisions.

10. AGREEMENT & ACKNOWLEDGMENT
By booking, paying for, or participating in a Reading, the Client acknowledges that they have read, understood, and agreed to all terms set forth in this Agreement.
